9/3/09 L'Oreal -v- eBay High Court case commences
The L'Oreal -v- eBay case has just begun to be heard at the High Court, London, before Mr Justice Arnold.
L'Oreal's basic position is that eBay should be liable for counterfeit and parallel goods sold on its website, and that eBay could do more to prevent the sale of such goods.
Argument in the case is likely to focus on the extent to which eBay has any direct involvement in the sale of such goods, with eBay arguing that it does not act as agent for the sellers, but that it merely provides a trading platform.
